ABOUT NEW DELHI HOUSE FLAT OWNERS ASSOCIATION
New Delhi House Flat Owners Association (NDHFOA), New Delhi House, 27 Barakhamba Road, New Delhi – 110 001 (NDHFOA) is the legal, genuine, legitimate and only association of New Delhi House Flat owners. As per the Memorandum of Article of Association (copy enclosed) every flat owner is a member of NDHFOA and this association was registered vide Registration No. 40272/2001. The aim and objectives of the association is to collect the funds from the members and carry out the aims and objectives of the association for betterment of New Delhi house building, to look after welfare and safeguard of the interest of the flat owners relating to water, electricity, fire fighting, security, cleanliness of the common areas, maintenances of the building and equipment including lifts and make it suitable arrangement for proper functioning of these tasks.
2. Elections to various posts of NDHFOA are to be conducted as per the Memorandum of Article of Association/constitution of NDHFOA.

Prior to 2012, the old executive committee of NDHFOA unfortunately, did not carry out the aims and objectives of the association and no attention was paid to the maintenance of the building resulting into water leakage in the flats, shafts, walls, floors, basement and the structure became weak due to rusting of the iron rods in pillars, shear walls, shafts etc. Lifts started falling down due to total absence of maintenance, compromising the life of flat owners/occupiers/visitors.

Due to non payment of drinking water bills amounting to more than Rs. 25 lakhs, NDMC disconnected the supply of drinking water and flat owners were forced to buy drinking water from the market and this cost itself was of the order of Rs. 50000/- per year, in addition to inconveniences. Similarly, no attention was paid to the security, cleanliness, painting of the common areas and the very purpose of the association was defeated, large part of the funds meant for New Delhi House building was syphoned off for personal gains. One agency namely, Capital Maintenance Corporation (CMC) was responsible for maintenance and day to day upkeep of the building and the staff of the CMC represented that they were not paid the salary in time, salary was very very less and the staff was to force manage additional income from the flat owners/occupiers by means of unethical ways and means.
5. Majority of the flat owners from various floors during 2012 came together and opposed the way of working of the then managing committee for betterment of NDH building. Transparency of the expenditure was demanded and this resulted into a large number of false and frivolous court cases against flat owners including eminent professionals and senior citizens. The court cases and FIRs were filed by the Advocate lady on the basis of incorrect and false facts including molestation case, SC/ST etc. Most of the court cases were filed on the basis of affidavit submitted by one Mr. H.M. Prabhakar, Son of Sh. R.R. Sharma, Resident of M-13, South Extn.-II, New Delhi who was never a flat owner of NDH building but claimed to be President of Apartment Owners Association of NDH. Number of other bogus and non existent associations have also been registered from Flat No. 112 of NDH. The members of NDHFOA/ flat owners were forced to defend the cases in the courts of law and Hon’ble Delhi High Court vide order dated 15.02.2016 passed in CRP 27 of 2015 (where Vijay Mehta and others were Petitioners Versus Association of Apartment Owners of NDH through Sunita Bhadwaj, Advocate) held that NDHFOA is a society which is in existence and ordered elections to various posts of NDHFOA under the aegis of an observer namely, Justice P K Bhasin, Retd. High Court Judge. Justice (Retd.) P K Bhasin vide order dated 29.04.2018 declared the result of NDHFOA elections and copy of the same is attached along with the copy of High court judgement.
6. Appeal was filed by Sunita Bhardwaj in Hon’ble Supreme Court of India but the order of Delhi High Court was upheld and hence the issue of legality/legitimacy of NDHFOA attained finality for New Delhi House building.
7. Various courts imposed penalty on Sunita Bhardwaj for wasting their time and not appearing with clean hands and the penalties reportedly still have not been paid.
8. It is surprising and shocking that the same persons with extreme disrespect to the superior courts are always making false allegations against NDHFOA and recently hacked the website namely www.ndhfoa.com. Now we have changed our website to www.ndhfoa.in.
9. After the 2018 elections, further elections were held on 25.11.2022 (late due to covid pandemic). Now the elections are scheduled as per the AGM cum election circular dated 25.06.2025 copy of which also appears in this website.
10. NDHFOA sincerely and with transparency worked hard to improve the condition of New Delhi House building and completed various jobs has also attached in the circular dated 26.06.2025 including:
- Installation of four new high tech power saver Schindler lifts
- Restoration of NDMC drinking water
- Upgrading the level of cleaning/upkeep of the common areas
- Installation of CCTV cameras at NDH
- Strengthening of NDH building as per the NDMC empaneled structural professionals
- Repair and renovation of eight sanitary shafts
- Replacement of old and rusted steel pipes by new Astral pipes
- Repair and renovation of basements
- Repair of fire fighting devices
- Repair and water proofing of underground and roof top water tanks
- Repair and renovation of the whole building from out side and inside and painting thereof
- Stopping the water leakage/seepage to the top floor flats etc. including repair, renovation of complete terrace.
All the members of NDHFOA are requested not to be mis-lead by the mischevious/ greedy/dishonest persons and contact General Secretary/President to ensure correctness of details of owners and correctness of list of members. Whenever elections are held members must actively participate the same enabling NDHFOA to have the benefit of their feed back/expertise/good ideas to make NDH as one of the best buildings in the centre of Delhi. It may not be out of context to mention that only those members can participate who do not have arrears of association funds as per section 15 of the Society Registration Act, 1860.
